SPECIAL MEETING LEVY COUNTY BOARD OF COUNTY COMMISSIONERS December 30, 1997 The Special Meeting of the Board of Levy County Commissioners was held on December 30, 1997 at 10:00 a.m. in the Levy County Board of County Commissioners’ meeting room, with the following Commissioners present: Chairman Sammy Yearty Comm. Wilbur Dean Comm. Don Lindsey Comm. Frank Davis
Also present were: County Attorney, Gregory V. Beauchamp Clerk of Court Douglas M. McKoy Administrative Assistant William C. Cobb
The Chairman called the meeting to order at 10:00 a.m..
RESOLUTION Rainbow Lakes Estates Chairman Yearty said the special meeting had been called to discuss the adoption of two (2) resolutions concerning Municipal Service Taxing Units (MSTUs) to fund municipal services for subdivisions. Mr. Greg Beauchamp read the resolution into the record for the Rainbow Lakes Estates Municipal Service District concerning the collection of assessments in accordance with Section 197.3632, F.S. allowing for amendments when needed. Mr. William Rees asked if this was an additional assessment to the land owners. Mr. Greg Beauchamp said this resolution was to allow Marion County to collect and disburse funds to Rainbow Lakes in accordance with the special legislative act enacted by the state. Comm. Dean moved to adopt the resolution for the Rainbow Lakes Estates Municipal Service Taxing Unit (MSTU). Comm. Davis seconded and the MOTION CARRIED. Comm. Dean said the assessments from the MSTUs is for funding the specific use it is assessed in the specific subdivision or development. Chairman Yearty said new developments require the roads meet county specifications and the plats will indicate the development will be subject to a MSTU. Mr. William Rees asked if the property owners are notified of the property being placed in a MSTU. Mr. Rees said he had been advised Rolling Pines #2 property owners were not aware of being in a MSTU. Mr. Skip Hammell said the plat for Rolling Pines #2 and the other proposed subdivisions have the information stamped on the plats for each individual owner when the property is purchased. Chairman Yearty said a MSTU District can be created in the older subdivisions by all property owners agreeing to the special assessment. Mr. Donald Richburg, Tax Collector said the resolution is the first step in the process to accept the MSTUs to be followed by public hearings before final action is taken by the Board. Mr. Greg Beauchamp read the resolution for the creation of a MSTU District for the subdivisions which were platted with the current land development regulations for the special assessment. Comm. Davis moved to adopt the resolution as presented. Comm. Lindsey seconded and the MOTION CARRIED. THERE BEING NO FURTHER BUSINESS THE MEETING ADJOURNED.
