EMERGENCY MEETING LEVY COUNTY BOARD OF COUNTY COMMISSIONERS June 24, 1998 The Special Emergency Meeting of the Board of Levy County Commissioners was held on June 24, 1998 at 9:00 a.m. in the Levy County Board of County Commissioners’ meeting room, with the following Commissioners present: Chairman Don Foley Comm. Wilbur Dean Comm. Sammy Yearty Comm. Frank Davis
Also present were: County Attorney Gregory V. Beauchamp Administrative Assistant William C. Cobb
The Chairman called the special meeting to order at 9:00 a.m. to address declaring a state of local emergency because of the severe threat of fire to lives and property to ban the sale, use or discharge of fireworks, and the use of flares, explosives, sparklers, or outdoor burning devices or otherwise lawful outdoor burning. Comm. Davis moved to declare a state of local emergency. Comm. Yearty seconded and the MOTION CARRIED. Mr. Greg Beauchamp read the state of emergency order as follows: A STATE OF EMERGENCY ORDER PERTAINING TO A BAN ON THE SALE, USE OR DISCHARGE OF FIREWORKS, AND THE USE OF FLARES, EXPLOSIVES, SPARKLERS, OR OUTDOOR BURNING DEVICES, OR OTHERWISE LAWFUL OUTDOOR BURNING
WHEREAS, a state of local emergency has been declared pursuant to Chapter 252, Florida Statutes, because of the severe threat of fire to lives and property to residents of LEVY County, Florida;
WHEREAS, due to the extraordinarily hot, dry, parched, windy conditions which continue to cause and exacerbate wildfires within LEVY county, Florida, further measures are required to protect Levy County citizens and visitors and to otherwise protect health, safety, welfare and property.
NOW, THEREFORE, in accordance with the emergency power vested in the County pursuant to Chapter 252, Florida Statutes, it is hereby ordered that, during the state of local emergency: 1. The sale, dispensing, use or discharge of fireworks (as defined in Florida Statute 791.01) and the granting of any permit for use of such fireworks, and the use of flares, sparklers, excepting therefrom organized fireworks displays conducted by or under the auspices of municipalities within Levy County and 2. The use of any outdoor burning devices (excluding attended and monitored bar-b-q/cooking equipment) and any otherwise lawful outdoor burning shall be prohibited throughout Levy County. Any person not abiding by this Order is guilty of a misdemeanor of the second degree punishable as provided in Florida Statute 775.082 or Florida Statute 775.083.

Comm. Yearty moved to adopt the emergency order. Comm. Davis seconded and the MOTION CARRIED. Chairman Yearty asked Mr. Billy Cobb to notify all local newspapers, radio stations and televisions stations to inform the citizens of Levy County of the emergency order.
THERE BEING NO FURTHER BUSINESS THE MEETING ADJOURNED.
