SPECIAL MEETING

LEVY COUNTY BOARD OF COUNTY COMMISSIONERS

November 24, 1998

 The Special Meeting of the Board of Levy County Commissioners was held on November 24, 1998 at 9:00 a.m. in the Levy County Board of County Commissioners’ meeting room, with the following Commissioners present:

Chairman Don Foley

Vice Chairman Frank Davis

Comm. Wilbur Dean

Comm. Lilly Rooks

 

 Also present were:

Clerk of Court Douglas M. McKoy

Administrative Assistant William C. Cobb

 

 The Chairman called the meeting to order at 9:00 a.m..

 EMPLOYEES, COUNTY

Comm. Foley said consideration needs to be given to the policy for overtime pay for county employees. Comm. Foley said a policy needs to be determined if overtime pay will be provided for pay periods containing a holiday. Comm. Foley said the current policy indicates forty (40) hours must be worked during a week to allow for over time pay otherwise the hours are paid at straight time.

Mr. Douglas McKoy, Clerk of Court said in clarifying the current policy, if an employee submits 48 hours including a paid holiday, the employee will be paid for 48 hours at straight time and not at the overtime rate of 1.5 of the hourly rate. Mr. McKoy said he had concerns about the section in the present contract providing that the contract supersedes all county directives.

Mr. Billy Cobb said adopting a policy would not create a conflict with the union agreement currently in place and prior to the adoption of the new union agreement.

Mr. McKoy said upon the approval of the union agreement the Finance Department needs to have a decision on if a special pay period should be considered for any retroactive pay which employees may be entitled to or if any retroactive pay should be paid through a regular pay period.

Comm. Foley said he recommended a special pay period for any retroactive pay upon the acceptance of the union agreement and the attending commissioners concurred.

Mr. Mike Schenk said sick leave should be struck out of the proposed union agreement which has been presented for review.

Comm. Rooks, Comm. Foley, Comm. Davis and Comm. Dean discussed adopting a policy to allow overtime pay to employees who work overtime during a week containing a holiday.

Mr. Billy Cobb said he contacted Mr. Greg Beauchamp, County Attorney and clarified the adoption of a policy for paying overtime at 1.5 the hourly rate to employees for weeks containing a paid holiday as Article 13 provides the authority to the Board for this action.

Comm. Davis moved to adopt a policy to pay employees overtime pay at 1.5 the hourly rate for any week over 40 hours including a paid holiday. Comm. Rooks seconded and the MOTION CARRIED.

 COMMISSIONERS

Comm. Dean moved to approve the bond application for the newly elected commissioner, Mrs. Lilly Rooks. Comm. Davis seconded and the MOTION CARRIED.
