The Special Meeting of the Board of Levy County Commissioners was held on October 15, 2013 at 9:00 AM in the Levy County Board of County Commissioners meeting room, with the following Commissioners present:

Comm. Bell called the Meeting to order at 9:01 A.M.  Comm. Joyner gave the invocation, followed by the Pledge of Allegiance.

 

 

JORDAN AND ASSOCIATES

 

Jeffrey Winter, Project Manager

Address results of testing regarding the Tarafa project; issue previously discussed at the October 8, 2013 Regular Meeting.

 

Mr. Winter spoke to the Board of the results of testing regarding the Tarafa project as previously discussed at the October 8th Regular Meeting.  Mr. Winter stated the Geotech Engineer’s report indicated there is a confining soil layer which is responsible for the septic systems failure and saturation of the drain field.  GSE Engineering and Consulting submitted a report to Jordan and Associates on October 9th identifying three (3) options

 

  1. Reduce water consumption by providing low-flow, no-flow toilets; low-flow shower heads and other measures to reduce water consumption in the home.

 

  1. Over excavate the confining soil which was dredged from the canal for this parcel of land and do some modeling to determine if this could reduce the septic fluids rising and breaking out the sides of the mound and going into the roadway.

 

  1. Breach through the confining layer of peat material and organic soil up to 30 feet.

 

A proposal received yesterday for a supplemental geotechnical site evaluation, October 14th outlined the cost of option #2 at a cost of $2,200.  If this option is not possible, the county could take advantage of mobilizing GSE Engineering on site to do supplementary testing to bore up to 30 feet below land surface to determine if option #3 would be feasible.  The cost of option #3 would be an additional $1,000.

 

Mr. Winter requested the Board approve Modification #3 to extend the grant for the time necessary to conduct the supplemental testing.  Upon receiving the engineer’s report and scope of work the issue can be corrected and move forward with getting the contract completed.

 

Ronald VanZant of Jordan and Associates spoke to the Board regarding options other than what has been presented to complete the project.

 

After discussion, Comm. Bell passed the gavel to Vice Chairman Johnson and made a motion to award Jordan and Associates a six (6) month extension, a letter to be prepared and sent to the DEO for a six (6) month extension for Levy County by Jordan and Associates, to set a ceiling of $10,000 maximum expense without future contact of the Board and a 30 day minimum “report card” to the Board of the progress of this project.  Comm. Bell included in his motion the approval of Modification #3 to Subgrant Agreement between the DEO and Levy County.  Second was made by Comm. Meeks.

After discussion, Comm. Bell amended his motion to change the 30 day minimum reporting of Jordan and Associates to the Board to reflect the requirement of 15 day reporting via e-mail or fax every 30 days in person to Ms. Neely or to the Board.

Vice-Chairman Johnson called for vote by the Commissioners and the MOTION CARRIES.

 

 

COUNTY COORDINATOR

Clarify funds approved for RAD, as presented by Lt. Tremblay during the July 2, 2013 Budget Workshop; as $3,000 for fiscal year 2013-14.

 

Mr. Moody brought to the attention of the Board a request for funding of the RAD Program presented by Lt. Tremblay during the July 2, 2013 Budget Workshop.  The amount requested of $3,000 will be expended by submitting purchase orders for items needed.

 

Comm. Joyner made a motion to approve $3,000 to be used for expenditures submitted for payment by the RAD Program.  Second was made by Comm. Meeks and the MOTION CARRIES.

The Special Meeting of the Board of Levy County Commissioners was held on August 30, 2013 at 11:00 AM in the Levy County Board of County Commissioners meeting room, with the following Commissioners present:

Comm. Bell called the Special Meeting to order at 11:05 A.M.  Comm. Joyner gave the invocation, followed by the Pledge of Allegiance.

 

 

LEVY COUNTY SHERIFF’S DEPARTMENT

 

Atty. Brown informed the Board of an event planned in Williston which has been brought to her attention as well as the Sheriff.  She stated there an Ordinance in place requiring application for a permit for such an event.  To date, there has been no application made for the event advertised for this weekend in Williston.

 

Sheriff McCallum spoke to the Board of safety concerns for the event being planned as it will be near an area where they have responded on numerous occasions recently to disturbances in the neighborhood of a night club.

Under-Sheriff Brett Beauchamp also spoke of traffic concerns along SR 27 and limited parking area.

Sheriff McCallum requested approval of the Board to have Atty. Brown seek an Injunction for unlawful assembly.

 

Comm. Joyner made a motion to allow Atty. Brown to proceed in seeking an Injuction to prevent the unlawful assembly or re-assembly concerning the event as requested by Sheriff McCallum.  Second was made by Comm. Stevens and the MOTION CARRIES.

LEVY COUNTY BOARD OF COUNTY COMMISSIONERS

Interviews for the Building & Zoning Director by the Board of Levy County Commissioners were held on March 7, 2013 beginning at 9:30 AM in the Levy County Board of County Commissioners meeting room, with the following Commissioners present:

Comm. Chad Johnson

            Also present were:

Comm. Bell called the meeting to order at 9:32 A.M.

 

Jacqueline Martin spoke to the Board explaining changes to a chart she had passed out to the Commissioners regarding the minimum experience qualifications of each applicant for the Building & Zoning Director position.  The Standard Building Code Administrator is the only minimum requirement.  A Certified Plans Examiner License or Certified Building Inspector License is preferred.  All three qualifications were listed as minimum experience requirements.

 

The two (2) applicants listed below were interviewed by the Board for the position of Building & Zoning Director:

The meeting reconvened at 11:12 A.M.

 

The Commissioners stated their preference for the applicants as follows:

After discussion, Comm. Johnson made a motion to form a Committee for salary negations consisting of Fred Moody, Jacqueline Martin and Comm. Bell.  Second was made by Comm. Joyner and the MOTION CARRIES.

 

Comm. Joyner made a motion to select William Hammond for the position of Building & Zoning Director.  Second was made by Comm. Johnson and the MOTION CARRIES.  Comm. Stevens votes NO.

 

The Committee agreed to meet with Mr. Hammond on March 11th at 9:00 A.M. for salary negotiations.  The results will be presented to the Board for approval at the next Board meeting.

 

Comm. Stevens made a motion to allow the Committee to negotiate a salary with Mr. Hammond up to $75,000 contingent upon him taking on the added responsibility of Code Enforcement.  This will also include the possibility of a “take home” vehicle.  Second was made by Comm. Meeks and the MOTION CARRIES.

The Special Meeting of the Board of Levy County Commissioners was held on October 31, 2012 at 11:00 AM in the Levy County Board of County Commissioners meeting room, with the following Commissioners present:

Comm. Stevens called the Meeting to order at 11:06 A.M.  Osborn Barker gave the invocation, followed by the Pledge of Allegiance.

  1. Ratify the Standard & Poor’s Rating Services Terms and Conditions Applicable to Public Finance Ratings.

 

  1. Approve Resolution 2012-68.

 

  1. Approve SEC Post-Issuance Compliance Services Pricing Agreement with DAC.

 

Mr. Cellon spoke to the Board explaining savings to the county on estimated expenses and by doing a total refund rather than an optimum for a net savings of $325,000 to $350,000.

Mark Mustain presented the Resolution which authorizes the issuance of the bonds and delegates the Chairman to sign a bond purchase agreement.  As long as this agreement is returned within the time parameters indicated, the county would get the interest rate resulting in the savings as discussed by Mr. Cellon.

 

Comm. Drew made a motion to ratify the Standard & Poor’s Rating Services Terms and Conditions Applicable to Public Finance Ratings, approve Resolution 2012-68 and approve the SEC Post-Issuance Compliance Services Pricing Agreement with DAC.  Second was made by Comm. Johnson and the MOTION CARRIES.

 

 

PUBLIC SAFETY

 

David Knowles, Director

Department of Public Safety is requesting Board approval to authorize Nabors, Giblin & Nickerson to complete the waiver documents for the narrowbanding project.  Creating and processing the waiver shall not exceed $6,000.

 

Mr. Knowles explained to the Board he and Atty. Brown had been working on the narrowbanding project with ICom America as well as Nabors, Giblin & Nickerson to execute the one-year waiver documentation to the Federal Communications Commission.  In doing so, there are some costs incurred which are not expected to exceed $6,000.  Mr. Knowles requested Board approval and the Chairman’s signature on the letter from Nabors, Giblin & Nickerson to execute this agreement and start the process.

 

Comm. Johnson made a motion to approve the Chairman’s signature on the letter from Nabors, Giblin & Nickerson to execute the waiver documents for the narrowbanding project, not to exceed $6,000.  Second was made by Comm. Bell and the MOTION CARRIES.

 

 

COUNTY COORDINATOR

Resolution 2012-67.  Commissioners requesting assistance from State and Federal Representatives to assist the Oyster Fishing Industry, the affected fisherman, their families and the Levy County Community; providing for notice to the Governor and Legislative Delegations; providing an effective date.

 

Mr. Moody requested Board approval of Resolution 2012-67, requesting assisting from State and Federal Representatives to assist the Oyster Fishing Industry, the affected fisherman, their families and the Levy County Community.

 

Comm. Bell made a motion to approve Resolution 2012-67 as requested.  Second was made by Comm. Johnson and the MOTTION CARRIES.

 

 

COUNTY ATTORNEY

Discussion and decision on salary increases or Performance Award Policy for Fiscal Year 2012-13.

 

Att. Brown informed the Board of State regulations concerning the issuance of bonuses to employees.  She stated bonuses would need to be open to all employees and based on work performance.  Each employee would be subject to an evaluation by their supervisor or department head and the end of this evaluation period will be December 7th.  Atty. Brown presented a policy to the Board which was created based on this information.  The bonus policy will have an expiration date.  All employees would qualify for the bonus, therefore a tiered system was presented and is detailed below:

 

Full-Time Employees                $600

Part-Time Employees               $300

On-Call Employees                  $150

 

Each of the Constitutional Officers would be responsible for the distribution of bonuses to their employees and it would have to come from the budgets which had already been set for the year.  It will be possible to have the bonuses included in employees pay after Thanksgiving, but not before due to the required paperwork.

 

Discussion followed as to whether to issue a separate check or include the bonus with a regular payroll check.

 

Mr. Barker spoke to the Board and requested they consider a bonus of $1,000 to all full-time employees rather than the $600 discussed.

 

Ann Moody spoke to the Board informing them of regulations which require 25% of the bonus amount be contributed to Federal Withholding if a separate check is issued.

 

Comm. Joyner proposed the Board consider adding 25% to the $600 bonus amount and issue a separate check to the employees.

 

Comm. Bell explained his reason for proposing the $600 amount.

 

Comm. Joyner made a motion to approve the bonus policy as presented contingent upon agreement with the Union.  Second was made by Comm. Drew and the MOTION CARRIES.

 

Comm. Drew made a motion to issue the bonus amount to employees within a single payroll check.  Second was made by Comm. Bell and the MOTION CARRIES.

            Recommend approval to waive Community Development Block Grant (CDBG) basic contractor qualifications under Chapter XIV, Section B(3)C of Exhibit I of the Housing Assistance Plan, “A certificate evidencing auto insurance including bodily injury in the amount not less than $1,000,000 per accident and in the aggregate.”

 

 

Ms. Neely stated there is a contractor requirement which appears to be excessive.  The requirement states “a certificate evidencing auto insurance including bodily injury in an amount not less than $1,000,000 per accident and in the aggregate” is included in the contractors’ application as required by the County Housing Assistance Plan.  Ms. Neely requested the Board waive this requirement as this is a hindrance to get contractors to bid.

 

Discussion followed by the Commissioners to follow the State minimum requirements for auto insurance.

 

Comm. Bell made a motion to waive this requirement for this bid procedure.  Second was made by Comm. Joyner and the MOTION CARRIES.

The Special Meeting of the Board of Levy County Commissioners was held on October 24, 2011 at 9:00 AM in the Levy County Board ofCountyCommissionersmeeting room, with the following Commissioners present:

Chairman Stevens called the meeting to order at 9:00 A.M.

 

Mr. Moody stated the purpose of the meeting was to hear from Steve Tocknell and the Transportation Department in a continuation of the agenda item which he presented on behalf of Ms. Painter during the Regular Board Meeting on October 18th.

 

Steve Tocknell spoke to the Board with regard to assisting the Transportation Department in application for a Tiger 3 Grant.  The grant is to be used for the rehabilitation of the Transportation Department bus maintenance facilities.

 

Discussion followed regarding the proposed purchase of property in which to move the bus facilities to.  It was also discussed there were County-owned properties which could be used for this purpose instead of purchasing property such as the Central Florida Electric property, which had been mentioned.

 

Mr. Moody read Board minutes where this grant was discussed to let the Commissioners know what had been approved up to this point.

 

Discussion followed regarding the contract with Mr. Tocknell.

 

Comm. Bell made a motion for a non-agenda item to approve the contract.  Second was made by Comm. Drew and the MOTION CARRIES.

 

Comm. Bell then made a motion the approve payment for the contract and completion of the project with the maximum amount of $8,000.  Second was made by Comm. Drew and the MOTION CARRIES.

 

Atty. Brown asked for clarification if the earlier approved Resolution 2011-56 should be rescinded and a new Resolution be prepared for approval at the November 8th Regular Board Meeting.

Comm. Stevens confirmed Atty. Brown’s statement.
